What is an email opt-in?
Updated · By Robert Breen
An email opt-in is a person's clear, active permission to receive marketing emails from your business, such as ticking a box or signing up for a newsletter. Double opt-in adds a confirmation email they must click before they are added to your list.
Why it matters for a small business
Sending marketing email to people who never agreed to it annoys them, gets your messages marked as spam and can break the law where you or they are. Spam complaints also hurt delivery for every email your business sends, including invoices and appointment reminders.
Rules differ by country and sometimes by state, and they cover things like how consent is collected, what the email must include and how quickly unsubscribes are honored. This page is general information, not legal advice. Check the rules where you send and where your contacts live, and have an attorney or other qualified professional review your signup forms and email practices.
In a real lesson: Build a Lead Magnet Signup Form with an AI Welcome Email
In the AI Lead Magnet Signup Form lesson, visitors to a page for Harbor & Pine Coffee Roasters, a made-up coffee brand, enter their name and email under the heading Get the Free Guide, with the line "The Better Cup at Home: our free brewing guide, sent straight to your inbox." After they submit, an n8n agent saves the lead to Google Sheets and emails the guide.
That signup clearly asks for the guide. It does not include a separate box saying "Also send me your newsletter and offers," because the lesson is about building the form and workflow, not about running a newsletter. If you build the same thing for your business and plan to keep emailing those people, add an unticked checkbox for marketing emails, save its value in its own sheet column, and only add people who ticked it to your marketing list.
The lesson's system message already has a habit worth copying: it limits what the email may say ("No discounts and no health claims"). Write your consent rules the same way, as plain, specific instructions.

Common confusions
Opt-in vs opt-out
Opt-in means people choose to join. Opt-out means you add them and they must ask to leave. Many places require opt-in for at least some marketing email, and opt-in lists usually get better engagement anyway.
Transactional vs marketing email
An order confirmation or the guide someone asked for is transactional: it delivers what they requested. A sale announcement is marketing. The rules for the two are often different, so keep them separate.
Tips
- Never pre-tick a marketing checkbox.
- Record when and how each person opted in, in a column next to their email.
- Put a working unsubscribe link in every marketing email and honor it quickly.

Frequently asked questions
- Does downloading a free guide count as an opt-in for my newsletter?
- Not necessarily. Asking for one thing is not always permission for another. Ask separately for marketing emails, and check the rules that apply to you with a qualified professional.
- Do I need double opt-in?
- It depends on where you and your contacts are and on your email provider. Even where it isn't required, it keeps typos and fake addresses off your list.
